Shop Terms of Use

These Shop Terms of Use (“Shop Terms”) supplement the Terms and Conditions of Trend App Inc. (“TREND App Inc.”, “TREND App”, “we”, “us”, or “our”) and apply specifically to your use of the TREND ecommerce marketplace platform (the “Platform”). Capitalized terms not defined here have the meanings given in the Terms and Conditions.

The Platform

The Platform enables transactions between Merchants and Buyers. “Merchants” are users offering products or services (“Products”) for sale. “Buyers” are users purchasing Products. TREND App Inc. provides the Platform as a marketplace venue only. We do not manufacture, warehouse, inspect, or guarantee Products sold by Merchants.

We do not control the quality, safety, legality, accuracy, or availability of Products. We make no representations regarding any Merchant, Buyer, Product, or transaction. Merchants are solely responsible for their Products and compliance with applicable laws.

When a Buyer purchases a Product from a Merchant, a legally binding contract (“Purchase Agreement”) is formed directly between the Buyer and the Merchant. TREND App Inc. is not a party to any Purchase Agreement and does not assume responsibility for any obligations, warranties, or liabilities arising from such agreements.

Users agree to notify TREND App Inc. of any disputes before initiating legal action and to participate in good‑faith informal resolution for at least 30 days if requested by TREND App Inc.

Merchant Eligibility and Commitments

To use the Platform as a Merchant, you represent, warrant, and agree:

  • You have all required licenses, permits, approvals, and authorizations to offer and sell your Products.
  • Your Products comply with all applicable laws, regulations, safety standards, labeling requirements, and industry guidelines.
  • You will comply with all TREND App policies, including our Privacy Policy, Shop Terms, Community Guidelines, and Child Safety & CSAE Standards.
  • You will not offer illegal, counterfeit, unsafe, restricted, or prohibited goods or services.
  • You are solely responsible for fulfilling, packaging, and shipping orders to Buyers.
  • You will use Buyer data only for order fulfillment, returns, refunds, and customer service — never for marketing, resale, or unauthorized purposes.
  • You will not sell, share, or misuse Buyer data in violation of applicable privacy laws.

Purchase Agreements

If you are a Merchant, you appoint TREND App Inc. as your limited payment collection agent solely for the purpose of receiving payments from Buyers. Payment to TREND App Inc. is considered payment to you. TREND App Inc.’s obligation to remit funds is conditional upon successful receipt of payment from the Buyer.

If you are a Buyer, you acknowledge that TREND App Inc. collects payments on behalf of Merchants but is not a party to the Purchase Agreement. Once you pay TREND App Inc., your payment obligation to the Merchant is satisfied.

Personal Information

By entering into a Purchase Agreement, you authorize TREND App Inc. to share necessary personal information with the other party for order fulfillment, returns, refunds, and customer service, as described in our Privacy Policy.

Billing, Payment, Fees, and Taxes

TREND App Inc. may use third‑party payment processors. You may be required to accept their terms and complete onboarding to receive payments. You agree to provide accurate information and authorize TREND App Inc. to share necessary data with payment processors.

TREND App Inc. may place payment holds, issue refunds, or provide credits in cases of suspected fraud, unauthorized charges, or misuse of the Platform.

Merchants are solely responsible for reporting and remitting taxes on amounts received. TREND App Inc. may deduct platform fees, chargebacks, refunds, overpayments, payment errors, undelivered goods, or other losses from Merchant payouts. If amounts owed exceed payouts, TREND App Inc. may charge the Merchant’s payment account on file.

Release

TREND App Inc. is not involved in the actual transaction, fulfillment, or performance of Purchase Agreements. If you have a dispute with another User, you release TREND App Inc. and its affiliates from all claims, demands, and damages arising out of such disputes.

WE EXPRESSLY DISCLAIM ANY LIABILITY ARISING BETWEEN USERS OF THE PLATFORM, EXCEPT FOR OUR ROLE AS A LIMITED PAYMENT COLLECTION AGENT.

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE THE PROTECTIONS OF CALIFORNIA CIVIL CODE § 1542 AND ANY SIMILAR LAW IN OTHER JURISDICTIONS.

Indemnification

In addition to your obligations under the Terms and Conditions, you agree to defend, indemnify, and hold TREND App Inc. and its affiliates harmless from any claims, liabilities, losses, damages, or expenses arising out of your Products, your Purchase Agreements, your conduct on the Platform, or your breach of these Shop Terms.
